When Mommy's Gone
Whenever my roommate leaves for the day, her two cats start going crazy. One of them, Circe, runs through the house yowling, looking for her mommy, at the same time carrying around one of her "babies." Her baby being a little mouse toy filled with catnip.

I feel terrible when she yowls like this, and I wish there was something I could do for her, lol. She really sounds like she is being tortured.

Usually, this behavior ends when she jumps on the kitchen counter, the top of the fridge, and then to the very top of the kitchen cabinet, where she curls up into a ball, with the "baby" more often than not, and sleeps all day.

What do your cats do when you or another of the "pride" leaves?

I like griefing as much as everyone else, but making a derivative work based on a copyrighted work is not defensible, even with the DMCA.

Even non-substantial use has actionable basis:

I also want to be clear here too, while the letter of the law says it is not defensible fair use, the options for the OP are limited pretty much to "QQ more nub".

Besides, I'm not sure the OP can actually _prove_ she owns the copyright to the item in question. So making threats and whatnot would be considered to be an abuse of the legal system.

Take it as lesson learned, and move on.

Lesson: The more you complain loudly, the worse it gets. Recent proof: wikileaks and Swiss Bank Julius Baer. The bank really got it good.

There is no way to prove that either you OR "your friend" has any kind of special rights to the image, since the distinguishing features of the image are not yours or your friend's. So I did not provide any information about you that you haven't already freely given online.

As you put the pictures out there, I modified one of the images through heavily editing it to create my own unique image.

I fail to see how I violated the ToS. I followed a link provided to me in a public forum to where you freely gave out your name in conjunction with with your screen name and your image. I used one of the images, heavily editing it to make a new unique image so it is fine to use under fair use rules. Even with the edit, it is still a factual statement in the image, unless you do not pet your cats, so no libel or slander can be claimed.

Please provide information on how I violated the ToS or stop threatening me, or I will be forced to file a complaint against you for threatenning me and making groundless claims against me.

Um, you may want to talk to someone who actually knows something about copyright law before you start spewing stupid crap. Yes, you posted the photo's with a note that you were reserving your rights under the copyright laws. That image was still made freely available for viewing, so our artist here was able to legally access the work. He then created a new derivative work as a parody to mock your asinine behavior. Since he is not doing this for profit, and his actions are not taking away from any profit you were receiving for the original work, it would most likely be found to be fair use were it to come to trial.

Now, as for posting identifying information about you Andrea, he would need to post more than just a first name to violate that rule. Hell, it wasn't even identifying you until you acknowledged that it was your name in this thread. There must be thousands of Andreas on ElJay, and you can't be the only Andrea on ElJay that is a crazy cat lady in training. Shit, all someone needed to do was Google your ElJay userid and they'll find your Flicker account with your first name. If you didn't want your real name to be associated with your ElJay, you never should have used the two names together online. Hell, even removing your name from your Flicker won't help, as I'm sure every post to this thread is being archived somewhere else online.

You are claiming th image is yours and that no one else can use it -- when the image clearly belongs to a 3rd party who has not given you permission to use it.

It's pretty obvious that she doesn't know the real legal definition of fair use.

She consistently exhibits a "folk" understanding of fair use and is under some serious misconceptions. The whole "if it's attributed it's fair use" thing for example. That's not a legally defensive position, although it seems highly unlikely that someone will sue her over the infringement.

I laid down the clue-by-four in a different comment here. Wikipedia has a good write up about it which, weirdly enough, is top hit on google.

I won't even talk about CC licenses, because that would explode some heads.
